1. Acceptance of Terms

By accessing or using AUBAIB.SPACE ("the Platform", "we", "our"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to both documents in full, you may not use the Platform. These Terms apply to all visitors, registered users, and anyone who accesses or uses any feature of the Platform.

2. Eligibility

• You must be at least 13 years old to create an account.
• Users aged 13–17 must have parental or guardian consent before registering.
• By creating an account you represent that you meet these requirements.
• We reserve the right to verify age and terminate accounts where eligibility cannot be confirmed.

3. Accounts & Security

• You are responsible for maintaining the confidentiality of your password and account credentials.
• You may not share, sell, or transfer your account to another person.
• You must notify us immediately at aubaib.mail@gmail.com if you suspect unauthorised access to your account.
• We are not liable for any loss resulting from unauthorised use of your account where you failed to take reasonable security precautions.

4. Acceptable Use

You agree to use the Platform for educational and collaborative purposes only. The following are strictly prohibited:

Violations may result in content removal, a temporary suspension, or a permanent ban, at our sole discretion.

5. User-Generated Content

"User Content" means any content you submit, post, or transmit through the Platform — including chat messages, articles, quiz answers, comments, KnowledgeSpark posts, and circle notes.

6. Intellectual Property

All platform assets — including the AUBAIB.SPACE name and logo, avatar designs (including the Pixi-art characters and skins), UI/UX, source code, lore, gamification system, and editorial content created by the AUBAIB team — are the exclusive property of AUBAIB.SPACE or its licensors, protected by copyright, trademark, and other intellectual property laws. You may not reproduce, modify, distribute, or create derivative works from any platform assets without prior written permission. Requests can be sent to aubaib.mail@gmail.com.

7. Gamification & Virtual Items

XP, AUBCoins, avatar items, outfits, badges, and leaderboard rankings are virtual in-platform rewards with no real-world monetary value. They cannot be transferred, traded, sold, or exchanged outside the Platform.

• We reserve the right to adjust, reset, or remove virtual items at any time — including for seasonal resets, system rebalancing, or confirmed cheating.
• No compensation (monetary or otherwise) is owed for loss of virtual items under any circumstances.
• Virtual items obtained through exploitation of bugs or in violation of these Terms will be revoked without notice.

9. Account Termination

You may delete your account at any time via Profile → Privacy & Data → Delete Account. Upon deletion, your personal data will be removed within 30 days in accordance with our Privacy Policy. We may also terminate or suspend accounts at any time for violations of these Terms. Termination does not entitle you to a refund of any purchased items or reinstatement of virtual items. Banned users may not create new accounts to circumvent enforcement actions.

10. Third-Party Links & Content

The Platform may contain links to third-party websites or display content from external sources (e.g. external articles curated from other publishers). We do not endorse and are not responsible for the content, accuracy, or practices of any third-party website or service. Accessing third-party links is entirely at your own risk.

11. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without any warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy of educational content, or non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or free of malicious components. Educational content on the Platform is user-generated or curated and should not be taken as professional academic, medical, legal, or financial advice.

12. Limitation of Liability

To the maximum extent permitted by applicable law, AUBAIB.SPACE and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, loss of profits, loss of virtual items, or interruption of service — arising from your use of or inability to use the Platform, even if we have been advised of the possibility of such damages. Our total aggregate liability to you for any claim arising from the use of the Platform shall not exceed the greater of: (a) the total amount you paid us in the 12 months preceding the claim, or (b) THB 500.

13. Indemnification

You agree to indemnify, defend, and hold harmless AUBAIB.SPACE, its operators, contributors, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of or access to the Platform; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party right, including intellectual property or privacy rights.

14. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Kingdom of Thailand, without regard to its conflict of law principles. Any dispute arising from or relating to these Terms shall first be attempted to be resolved through good-faith negotiation between the parties. If unresolved within 30 days of written notice, disputes shall be submitted to the exclusive jurisdiction of the competent courts of Bangkok, Thailand. For users in the EU, mandatory consumer protection rights under your local law are not affected.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be announced on the Platform and via email to registered users at least 7 days before taking effect. What constitutes a "material change" is at our reasonable discretion but includes changes to user rights, liability caps, or governing law. Continued use of the Platform after the effective date of any revision constitutes your acceptance of the updated Terms.
